These general contractual conditions are intended to establish the terms and conditions which shall be guidelines of all travel services provided by Lux Invicta - Tourism, Culture and Heritage Ltd, with its headquarters located at Avenida professor Joaquim Vieira natividade, 64  - 2460 071 ALCOBAÇA - PORTUGAL, with a business equity of € 20,000, VAT number 509 222 897, under the official licenses issued by Turismo de Portugal, I.P.: RNAVT 4218/2013 and Tourist Activities Permit 9/2010. The company operates in cultural-historical tourism, creating products that contribute to the development and dissemination of cultural heritage, both tangible and intangible history of Portugal.

A. Privacy Policy
A.1. This site is property of by Lux-Invicta - Cultura e Património, Lda. Whilst using the site hosted on www.luxinvicta.pt or its information, data archives, texts, graphics, links, audio, photos, vídeos ou other images, resources and services available through the site, the user, either as a participant or visitor, agrees with the terms of use, privacy policy and info protection in the paragraph 1.2.
A.2. In agreement with the Portuguese law - Protection of Personal Data Act 67/98 - we inform you that the data provided in this website is public and shareable with other third ones. If wish to present this on public, please ask our permission. Transposing, might activate the Portuguese legal system Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. A.3. Under no circumstances should you use the site for any purpose other than the purpose of the site, including unlawful purposes or any other purposes that might be considered prejudicial to the company's image. Plagiarism, falsification and use of content usurped or counterfeit and legitimate identification beyond unfair competition, are crimes punishable by law.
A.4. You shall not create or post any type of virus.
A.5. It is forbidden by copyright law to copy, modify, rent, loan, sell, distribute or create a derivative work based on the content that refers (partial or total), except with the express consent of the company.

1. Tours and Packages
1.1. The various tours and packages presented in this catalog are copyrighted products prepared by the company. They are operated by a Tour Guide speaking fluently the customer’s language.
1.2. Lux Invicta tours are operated in different vehicles depending on the number of people: Up to 8 people in Vans. Between 8-14 people on mini- bus. More than 15 people in tourism buses hired by the company.
1.3. Buying a day tour or a tour package (private or in group) ensures the customer transportation, guide service throughout the day and throughout the trip, admission tickets to monuments when mentioned, tasting of traditional sweets when mentioned, wine tasting when mentioned, accommodation and meals at quality hotels or family traditional accommodation from 3-5 stars, insurance coverage in accordance to Portuguese law. Any extra is not included in the tour and will be the responsibility of the customer. Any changes will be according to customers’ demands.
1.4. Some monuments are closed on certain days of the week. The company avoids these days by creating “exceptions”. However, the monuments may close without prior notice or on national closure days like Easter holidays, January 1st, May 1st and December 25th, so the company cannot guarantee visit at these days.

2. Reservations and Payments
2.1. In order to confirm a reservation of a multi-day tour package the customer must deposit 50% of the full quotation, settling the remaining amount 30 days before arrival. 
2.2. The Lux Invicta Ltd reserves the right to cancel any reservation for which payment has not been effected under the above conditions.
2.3. Price changes in packages: The budget sent to our customers expire after 15 days. After that period, prices may increase due to several changes according to availability of the hotel partner, transportation partners, tour guides, and other services included in the packages.
2.4. Payments can processed by one of the following methods:
2.4.1. Bank Wire Transfer: Necessary to send bank receipt.
2.4.2.        Visa Unicre ( Visa, Martercard and Maestro ) - Visa Unicre is a secure electronic transaction company operating in Portugal for decades.

3. VAT
3.1. Quoted prices already reflect the value added tax (VAT) at the current rate. This fee is mandatory in EU countries and where the service is operated.

4. Cancellations, NO-SHOW and Changes
4.1. The customer may cancel your trip at any time, however, should take into account paragraph 8 for more information.
4.2. The agency reserves the right to cancel the package if the number of participants is less than the minimum required. In these cases, the customer will be informed in a written message, and the Agency exonerated from any responsibility for the cancellation.
4.3. In case of NO-SHOW (no show upon date, time and meeting point), the agency will not make any refund of the amount relating to the trip of that customer. It applies to all services.
4.4. If the client prefers, and if possible to the travel agency, changes can be made to departure dates, hotels, room type, vehicle transportation, selected restaurants and places to visit, with at least 15 week days in advance.
4.5. Customers may also reallocate their participation and payment with a substitute person who satisfies all the conditions required for the trip, provided of notification to the agency at least 15 days in advance and acceptance of service providers included in the trip.
4.6. Whenever there are sufficient reasons, the agency may change the order of the itinerary or services provided, like hours of departure or replace any hotel initially planned by others of similar category. If unforeseen circumstances force the agency to suspend any trips, customers will be entitled to reimbursement of the amounts already paid.

5. Luggage Responsibility
5.1. The Agency only takes responsibility for any damage or loss of luggage in multi-day tour packages (land transportation) when luggage has been kept in the car trunk/boot, up to a maximum limit of  75 EUR. As it is considered to be the most appropriate place to ensure the safety of the most precious and important items of our customers, and not visible to the outside.
5.2. When luggage is kept inside the hotel room, it is at the customer’s responsibility. One should keep its belongings in a safe place and locked if possible.
5.3. Under no circumstances is the agency will be responsible for the loss or theft of valuable items such as gold, diamonds, jewelry, silver and money, personal documents, credit cards, notary documents, projects, paintings or art manuscripts. 
6. Insurance
As required by law, Article 35 of Decree No 199/2012 of 24 August, the services operated by Lux Invicta Ltd are covered by liability insurance.

6.1.1. Contracted guarantees: The minimum amount covered by insurance is 75,000 EUR, covering the risks arising from the activity, guaranteed compensation for property damage and personal injuries caused to clients or third parties by actions or omissions of Lux Invicta or their representatives.
6.1.2. The repatriation of customers and their assistance
6.1.3. The medical care and necessary medicines in the event of accident or illness occurring during the trip, including those which are necessary after completion of travel.

7. Documentation
7.1. Clients should always have with them updated personal documentation (passport, permits, updated vaccines, documentation regarding dietary restrictions, etc.).
7.2. Under no circumstances the agency will be held responsible for the loss or theft of our customer’s personal documents such as passport, driving license, ID cards and bank debit or credit cards.

8. Refunds
8.1. At any time the customer may withdraw from the tour package / stay by written communication. If the client communicates his cancellation within the deadline, he will be entitled to the amount described in paragraphs 8.3. or 8.4.
8.2. The agency's refund policy varies depending on the type of product, day trips or tour packages.
The percentage indicates how much is returned to the client for what has been paid until the time of cancellation:
8.3 Day trips (day trips without accommodation)
More 48 hours before the service  75%
Less than 48 hours before the service 0% (no refund)

8.4 Tour Package (organized trips for more than 1 day with accommodation included).
Land Services & Hotels:
30 days before arrival - 80%
From 30 days to 7 days - 25%
Less than 7 days - 0%

Groups: ( More than 10 people )
Depend of each hotel and partner  terms & conditions.

Refund will be made within 2 months
9. Complaints
9.1. Clients reserve the right to complain for the services provided or any other aspect that has gone against the quality of service. These complaints shall only be considered when submitted in writing to the agency where the booking and payment was made, within no more than 15 days after the end of the services. 9.2. Likewise, we only accept complaints that have been communicated to the respective suppliers (hotels, guides, local, etc.) during the course of the journey or stay, requiring the legal complaints book for this purpose.

10. Closing Days
10.1. Company closes on 25 December, 1 January and Easter day.
